Terms & Conditions

Welcome to Fairbrother Outfitting (“Company,” “we,” “our,” or “us”). By booking a hunt, reserving lodging, participating in any activity, or using our website, you agree to the following Terms and Conditions.

1. Assumption of Risk

Hunting, fishing, outdoor recreation, and backcountry lodging involve inherent risks, including but not limited to:

  • Firearms and archery equipment use
  • Wildlife encounters
  • Uneven terrain and natural obstacles
  • Weather-related hazards
  • Remote medical access

By participating in any activity with Fairbrother Outfitting, you acknowledge and voluntarily assume all risks associated with such activities.

All participants will be required to sign a separate Liability Waiver and Release Agreement prior to participation.

2. Booking & Deposits

  • A non-refundable deposit of $500 is required to reserve hunt dates.
  • Dates are not secured until the deposit is received.
  • Remaining balance is due upon check-in at time of arrival.
  • Failure to remit final payment by the due date may result in forfeiture of your reservation and deposit.

3. Cancellation Policy

  • Deposits are non-refundable; however, they are transferable to another hunt year or another hunter.
  • No refunds will be issued for early departure, missed days, or unsuccessful harvest.

4. Licensing & Legal Compliance

All hunters are responsible for:

  • Obtaining proper state hunting licenses and tags
  • Meeting hunter safety requirements
  • Complying with all state and federal wildlife regulations

Fairbrother Outfitting is not responsible for denial of tags, license errors, or regulatory violations by guests.

5. Weapons & Equipment

Participants are responsible for providing safe, properly functioning firearms or archery equipment unless otherwise arranged.

All firearms must:

  • Be transported and handled in compliance with applicable state and federal law
  • Be used only under guide supervision

Unsafe handling may result in immediate termination of the hunt without refund.

6. Conduct & Safety

We reserve the right to remove any participant from the property or terminate services without refund if:

  • They exhibit unsafe firearm behavior
  • They are under the influence of drugs or excessive alcohol during hunting activities
  • They engage in reckless, illegal, or disruptive conduct

Safety is our highest priority.

7. Physical Condition & Medical Disclosure

Participants must be physically capable of safely participating in the booked activity. You agree to disclose any medical conditions that may affect your participation.

We are not liable for injuries or medical conditions arising from undisclosed health issues.

8. Travel Delays

Fairbrother Outfitting is not responsible for:

  • Weather delays
  • Airline cancellations
  • Natural disasters
  • Government restrictions
  • Illness outbreaks
  • Events beyond our reasonable control

Refunds for delays or cancellations resulting from such events will be issued solely at our discretion.

9. Harvest Policy

While our guides work diligently to provide quality opportunities, wildlife is unpredictable.

  • We do not guarantee harvest success.
  • No refunds or credits are provided for unsuccessful hunts.
  • All harvested game must comply with state regulations.

10. Property & Lodging

Guests agree to:

  • Respect lodge property and equipment
  • Pay for damages caused by negligence
  • Follow posted rules

Fairbrother Outfitting is not responsible for lost, stolen, or damaged personal property.

11. Media Release

Unless otherwise requested in writing, participants grant Fairbrother Outfitting permission to use photographs and video taken during activities for marketing, website, and promotional purposes without compensation.

12. Website Use

All website content is the property of Fairbrother Outfitting and may not be reproduced without permission.

We make reasonable efforts to ensure information accuracy but do not guarantee that website content is error-free.

13. Indemnification

You agree to indemnify and hold harmless Fairbrother Outfitting, its owners, guides, employees, and affiliates from any claims, damages, or liabilities arising from your participation.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Montana, without regard to conflict of law principles.

Any disputes shall be resolved in the courts of Sanders County, MT.

15. Modifications

We reserve the right to update these Terms and Conditions at any time. The most current version will be posted on our website.
